The right of rescission allows a consumer to cancel the purchase of a used car within a certain period of time after the sale. The time period for cancellation varies depending on the circumstances of the sale, but it is generally three days.
To exercise your right of rescission, you must notify the dealer in writing of your intention to cancel the sale. You must also return the car to the dealer in the same condition as when you bought it.
If you comply with these conditions, the dealer must refund your purchase price, less any finance charges and other allowable fees. The dealer may also charge you a reasonable fee for any damage to the car.
If the dealer refuses to refund your purchase price, you may be able to file a complaint with the Utah Department of Motor Vehicles. The DMV can investigate your complaint and take action against the dealer if they find that there has been a violation of the law.
