What is Ohio law for returning a newly purchased vehicle?

In Ohio, consumers have three business days to return a new vehicle without penalty. The buyer must provide written notice to the dealer and return the vehicle in the same condition it was purchased in. However, the buyer may be responsible for a "reasonable" restocking fee.

To qualify for the three-day right of rescission, the following conditions must be met:

- The vehicle is a new motor vehicle, which is defined as a vehicle that has not been previously titled or registered in another state.

- The vehicle was purchased from a licensed Ohio dealer.

- The buyer is the original purchaser of the vehicle.

- The buyer has provided written notice to the dealer of their intention to return the vehicle within three business days of the date of purchase.

- The vehicle is returned to the dealer in the same condition it was purchased in, with no more than 500 miles on the odometer.

If all of these conditions are met, the buyer is entitled to a refund of the full purchase price, including any down payment, taxes, and fees. However, the dealer may charge a reasonable restocking fee, which cannot exceed $500.

If the dealer refuses to accept the returned vehicle or refund the purchase price, the buyer may file a complaint with the Ohio Attorney General's Office.

It's important to note that the three-day right of rescission does not apply to used vehicles or vehicles that are purchased from private individuals.
